Cuomo signs legislation adding e-cigarettes to Clean Indoor Air Act

E-cigarettes and vaping are being banned in indoor public areas in NY, after Gov. Andrew Cuomo signed a bill into law that will place the same restrictions on new and old nicotine delivery systems.

The bill adding e-cigarettes to the state Clean Indoor Air Act was sponsored by Assemblywoman Linda Rosenthal and state Sen. The blanket restriction will not apply to people who want to use e-cigarettes in private homes, in hotel rooms, or at retail tobacco outlets.

"Smoking bans, sold on the idea of alleged harm to non-smokers from the ambient cigarette smoke of smokers, are being revealed to be cover for social engineering instead", said Audrey Silk, founder of New York City Citizens Lobbying Against Smoker Harassment, or CLASH.

"These items are marketed as a healthier alternative to cigarettes, however the reality is they likewise convey long haul dangers to the health of users and those around them", Cuomo said in a release. "This measure closes another risky loophole in the law".

The New York State Court of Appeals rejected the most recent challenge to New York City's ban earlier this year, finding the inclusion of e-cigs in the law was valid.

But proponents of vaping argue that e-cigs are a safer alternative to cigarettes. Alexandra Miller said people should not vape or smoke indoors.

In July, Cuomo banned the use of e-cigarettes on the grounds of all state schools. "This measure closes another unsafe loophole in the law, creating a stronger, healthier NY for all", said Govenor Cuomo. "They don't feel like doing it anyway because it's obnoxious". He added that most of his customers use it as a way to quit tobacco cigarettes.

Vaping is starting to go down the same path as smoking.
