While Ezekiel Elliott continues to insist that he is fighting for his name, his attorneys have attempted to settle his case with the National Football League and have the Dallas Cowboys running back's six-game suspension reduced, a source close to the situation told ESPN.

The 2nd U.S. Circuit Court of Appeals will hear Elliott's six-game suspension appeal on Thursday. "We don't anticipate that changing and we'll just play the situation out day by day". Elliott, who was not arrested or charged in the case, maintains his innocence after being accused of assaulting his former girlfriend in Columbus, Ohio.

If Thursday's motion is denied, Elliott's six-game suspension will be back on and he'll be forced to leave the team unless his legal team wins their appeal of the district court's decision. That will allow Elliott to remain active until the U.S. Court of Appeals for the 2nd Circuit rules on whether he deserves an injunction as the merits of the case are determined.

Elliott will remain eligible to play until a ruling is handed down, and with the hearing scheduled later in the week, that likely improves the running back's chances of remaining eligible for Week 10 against the Atlanta Falcons.

Elliott was not allowed to be at the team's training facility in Frisco, Tex., Wednesday or Thursday after U.S. District Court Judge Katherine Polk Failla denied Elliott an injunction after a status hearing in NY on Monday.

Last year's National Football League rushing champion, Elliott had 93 yards and outgained 2017 rushing leader Kareem Hunt.
